The Nigerian Bar Association (NBA), has appealed the judgment of Hon Justice Tsoho of the Federal High Court Abuja, which nullified the 2015 Constitution of the Association as amended.
The Notice of Appeal has been served on the Plaintiff (now Respondent) Mr. Olasupo Ojo.
Confirming receipt of the Notice of Appeal Ojo noted “Today, the NBA served me their Notice of Appeal and a Motion for Stay of Execution of the declaratory judgment delivered in favour of Olasupo Ojo. No date has been fixed for the motion”, he said.
It would be recalled that in a suit filed by Mr. Olasupo Ojo, a lawyer, challenging the procedure of amending the said constitution, the Federal High Court had nullified the 2015 Constitution of the NBA. The Judge also held that pursuant to Section 600 of CAMA the non-registration of the constitution renders it void. The Defendant’s claim that the plaintiff lacked locus standi to bring the suit was also missed by the court who noted that what was in issue was interpretation of the constitution of an association. The Court further held that the Corporate Affairs Commission (CAC) need not be a party in the proceedings.
