Kanu Files Cross-appeal At Supreme Court

The embattled leader of the Indigenous People of Biafra (IPOB), Nmandi Kanu, through his lawyer Mike Ozekhome has filed a cross-appeal in response to the judgement of the Court of Appeal, Abuja judicial division, delivered on 13 October 2022 which ruled that Kanu be released. The judgment was subsequent appealed by the federal government where it asked the apex court to stay the execution of the October 13 Court of Appeal judgment that freed the leader of the separatist group.

DNL Legal and Style reports that in the notice of cross-appeal dated 7 November 2022, it raises three grounds of appeal on issues two, three and five of the judgment.  The appeal seeks the following reliefs:

“A. An order of this honourable court allowing the cross-appeal and setting aside in its entirety, the judgement of court below made on the 13th of October 2022, as it relates to issues 2, 3 and 5 formulated before the court.

B. An order of this honourable court directing the respondent to forthwith release the cross-appellant unconditionally from the custody of the State Security Service (SSS) where he has been kept since 26th June 2022, when he was forcibly abducted from Kenya and consequently extraordinarily renditioned to Nigeria.

C. And for such further order or orders as this honourable court may deem fit to make in the circumstances of this cross appeal.”

No date has been fixed for hearing the appeal.
