Honourable Justice A. Oyebanji of the Ikeja High Court has dismissed the application filed by Adesina Ogunlana to stop the Nigerian Bar Association (NBA) National Election scheduled to hold on the 29th and 30th of July, 2020.
Ogunlana had following his action in suit No. ID/4015 GCM/2020, filed an application for interlocutory injunction praying the Honourable Court to either compel the NBA Electoral Committee to include his name as contestant in the forth coming election or restrain the electoral body from conducting the election until the substantive suit is determined.
His suit was against the trustees of NBA, Mr. Paul Usoro SAN, MR. Jonathan Taidi, members of the ECNBA and the immediate past Chairman of the NBA Ikeja Branch.
The court heard both the Preliminary Objections and Court Affidavit to the Application for Injunction filed by the Defendants together and dismissed both the Preliminary Objections and the application for injunction.
On the Application for Injunction, Justice Oyebanji held that the Applicant has not established any legal right to be protected. The Court stated that having failed to present a letter of good standing as contained in the ECNBA Form 01, the Applicant did not comply with the condition precedent to contest in the election.
Dr Paul Ananaba SAN represented the Trustees of the NBA, Rotimi Seriki represented NBA President and the General Secretary while Samuel Agweh SAN represented ECNBA Chairman and Secretary.
