FCT High Court Stays Proceedings In Magistrate Court Case

Justice Bello Kawu of a Federal Capital Territory (FCT)  High Court,  Kubwa, Abuja has stayed proceedings in suit CR/49/2020 between Kenechukwu Okeke and Deji Adeyanju &  49 others at a Chief Magistrate Court II,  Wuse Zone 6, Abuja.

The judge issued the order following a Motion Ex-parte application by the applicants, Adeyanju (representing  himself and 49 others.

Justice Kawu also restrained the police from arresting the applicants under any guise pending judicial review of proceedings of the matter  before Chief Magistrate Omololu Akindele.

The first to third respondents are Kenechi Okwuokeke,  Nigeria Police Force and Commissioner of Police, FCT Police Command respectively.

The judge, after hearing applicants’ counsel, lhensekhien Samuel Jnr., granted all their prayers.

Kawu granted leave to the applicants to issue and serve on the defendant an application for judicial review against the proceedings/Direct Criminal complaint on Chief  Magistrate Omolola Tolulope Akindele sitting at Chief Magistrate Court II,  Wuse Zone 6 in the Suit No. CR/49/2020.

The court also issued an order transferring  the entire proceedings’ case file and the entire proceedings/ Direct Criminal complaint on Chief  Magistrate Tolulope.

The court further ordered the second and third defendants against taking any further step towards arresting the applicants or taking any unconstitutional steps in the form of any guise as it concerns all parties in the proceedings.

The judge adjourned hearing till February 25
