NBA 2018 Election: Afam Osigwe Seeks Injunction Restraining Conduct of Election

A High Court in Anambra State has ordered Mazi Afam Osigwe to put the Nigerian Bar Association (NBA) and all the Defendants on notice of his application seeking for an injunction restraining the conduct of the NBA national Election scheduled to hold between 27 and 28 July, 2018.

Honourable Justice Chukwudi C. Okaa, made the order dated July 16, 2018 upon hearing argument on the ex-parte application by Mazi’s counsel Mr. Emeka Etiaba SAN seeking an order of interim injunction restraining the Defendants either by themselves, their agents, officials, officers or privies from conducting, organizing, holding, in any manner whatsoever proceeding with and or concluding the election into the office of the President of the Nigerian Bar Association, pending the determination of the Motion on Notice.

It is hereby ordered as follows:

In view of the averment that the election is already fixed for for the 27th -28th of July, 2018 and taking judicial notice that the issues relates to the entire Nigerian Bar Association, I hold the strong view that it will not be in the interest of justice to hear the application Ex-parte. I will therefore order that all the parties be put on notice of the application to enable the court hear all the sides in the matter.

Mazi Afam Osigwe had filed the instant suit challenging his alleged unlawful disqualification from running for the office of the President of the Nigerian Bar Association. The Defendants are: the Incorporated Trustees of the NBA, Mr. Abubakar Balarabe Mahmoud SAN, President of the NBA;  Prof. Auwal Yadudu chairman of the ECNBA, Pascal C. Ugwuanyi, Chairman of NBA Nnewi Branch.

The suit has been adjourned to Thursday, 26th July, 2018 for hearing of the motion on notice at the Nnewi High Court.
