A principal Area court Judge based in Lokoja, Kogi state capital, Mr Sikiru Isah Oba has dragged the Kogi Judicial Service Commission before the National Industrial Court, challenging his dismissal.
The suit instituted by one Sikiru Isah Oba is challenging his alleged wrongful dismissal from the service of Kogi state judicial service commission where he served as principal Area court judge 2 until the 8th May 2017 when his appointment was terminated.
In a suit no NJCN/Lokoja/05/2018 the claimant among other prayers sought the order of the court to declare his dismissal null and void.
He also urged the court to order the Judicial service commission of Kogi state to pay all his entitlements including his half salaries from May ,2017 when he was suspended to December and full salaries from January 2018 when he was dismissed up to date.
The claimant also sought a declaration that being in the employment if the defendant as civil servant who has been employed and confirmed is protected by the civil service rule statutes and laws which make his employment tainted with statutory flavour.
He also sought a declaration that his suspension letters dated 8th May 2017 with reference number JSC/SEC/P/277/VOL.1/99 and another dated 15th May with reference number CIR/SEC/P277/VOL/1/90 even before any complaint was lodged with the defendant is a clear demonstration that the defendant was his accuser and at the same time his prosecutor which was in breach of natural justice and the entire trial by disciplinary committee, as such was a nullity.
