Court of Appeal sitting in Abuja today, struck out an appeal filed by Corporate Affairs Commission (CAC)’s appeal against Abuja lawyer Ashimole Felix Chukwuma for lack of diligent prosecution.
CAC had filed a suit at the Federal High Court Abuja, seeking among other, a declaration that Ashimole Felix’s protests against poor service delivery by CAC, is illegal, nuisance and conduct unbecoming of a legal practitioner. Judgment in the suit was delivered in favour of Ashimole in 2011 hence the CAC’s appeal.
Both CAC and its lawyer Chief Akpan Nkereuwum were not in court while the Respondent, was represented by Obi Nwakor, Esq.
Meanwhile, Mr. Ashimole has also filed a Fundamental Right Enforcement action at FCT High Court challenging the removal of his name from the register of accredited customers of CAC, denying him access to all offices and premises of CAC nationwide.
The suit comes up next week.
