The Nigerian Bar Association Lagos Branch has upturned its earlier decision to conduct its Branch general election under its 2003 by-laws. This decision was made at its Extra Ordinary General Meeting held on 28th June, 2017. By this decision, the branch election would now hold under the 2015 by-laws as directed by the NBA National Executives at its NEC meeting in Kogi State.
It would be recalled that the NBA Lagos Branch had at an EGM resolved that its general election would be held under the old 2003 by-laws in view of the Federal High Court Judgment nullifying the 2015 by-laws. This decision did not settle well with the National Body who immediately gave a directive that elections conducted under the old 2003 by-laws would not be recognized.
Undeterred by the threat issued by the National body, the NBA Lagos Branch at its June, 2017 monthly meeting, stood its ground and resolved to proceed with the conduct of the election on the basis of the 2003 old by laws.
In a sudden twist of event, the NBA branch circulated a notice of EGM whose only agenda was to further deliberate on the by-law to be relied on for the upcoming election. At the meeting, the decision to upturn the earlier resolution of the branch was put to vote where 175 members voted in favour of conducting the election under the 2015 by laws to bit 75 members who voted in favour of sticking to the earlier decision on the old 2003 by laws.
The voting followed the open reading of a letter written to the Branch by the NBA President A.B Mahmoud SAN appealing that the branch adhere to the decision reached at the Lokoja NEC Meeting. The letter noted further that the amended 2015 constitution has already been registered with the CAC and the fact of its registration has not been challenged by anybody so far.
Another major decision taken at the EGM was the postponement of the election which was ealier slated for 29th June, 2017. A new date for the election is to be announced.
