Nigerian Musician Damini Ebunoluwa Ogulu, popularly known as Burna Boy is facing a lot of court actions at the moment. Barely one month after a US Court him from performing in the US and Canada for breach of contractual relationship with a Nigerian owned US based company Vibesland Entertainment, LLC, a Nigeria company Insecta Studios Limited has also slammed the Musician with a N20 million suit for copyright infringement.
The US Court had granted an injunction restraining Burna Boy from performing at any event venue or any form of recording anywhere in the US and Canada for the time being until Burna Boy Limited settles the promoter for the financial loss Vibesland Entertainment, LLC owned by a Nigerian, Niyi Fatogun.,
In another development, Insecta Limited’s suit is for copyright infringement. In the suit filed today at the Federal High Court Lagos with Suit No. FHC/CS/L/847/17, the Company alleged that Burna Boy utilized its artistic work for commercial gains without its consent. The Company’s reliefs as set out in the writ of summons are
A DECLARATION that the copyright of the Plaintiffs in respect of the artistic work sent by the Plaintiffs to the 3rd Defendant on 1st November, 2016 was infringed upon by the Defendants jointly and severally.
AN INJUNCTION restraining the Defendants, their assigns, agents or privies from further using of the said artistic work in the future without the consent and approval of the Plaintiffs.
AN ORDER for the payment of ₦20,000,000 (Twenty Million Naira) being general damages for infringement of the Plaintiffs’ copyright and for using the Plaintiffs’ artistic work for commercial gains.
AN ORDER of the Honourable Court compelling the Defendants to publish a public apology in a reputable national newspaper for infringement of the Plaintiffs’ copyright.
AN ORDER compelling the Defendants to publicly acknowledge the Plaintiffs’ copyright and authorship of the artistic work in a reputable national newspaper and on the Defendants’ social media platforms.
The suit has not been assigned to any judge yet.
